Terms of Use

These Terms of Use ("Terms") apply to your use of the website at https://primegala.co.ke (the "Site") operated by Primegala Medical Center and Nursing Home ("Primegala", "we", "us"). By using the Site you agree to these Terms. If you don't agree, please don't use the Site.

1. Not for emergencies

This Site must not be used for medical emergencies. If you or someone else needs emergency care, call 999 or 112, or go to the nearest health facility immediately. Primegala is open 24 hours at Nakuru–Nyahururu Road, Maili Sita Centre, opposite Kiamaina Primary School, Kabatini Ward, Nakuru County, Kenya.

2. Information only, not medical advice

Content on the Site, including Health Hub articles and health tips, is general information. It is not a diagnosis or a substitute for a consultation with a qualified health professional. See our Medical Disclaimer.

3. Appointment and callback requests

• Submitting a form or WhatsApp message is a request, not a confirmed appointment. An appointment is confirmed only when our team contacts you.
• We aim to respond promptly but cannot guarantee a specific response time.
• Please give accurate details. Don't submit requests on behalf of others without their permission.
• Walk-in and urgent patients are prioritised according to clinical need (triage).

4. Fees and SHA

Information on the Site about SHA cover, fees and payment methods is a general guide and may change. Your eligibility and any costs are confirmed at our front desk before treatment. SHA benefits are determined by the Social Health Authority under the Social Health Insurance Act, 2023 and its regulations.

5. Acceptable use

You must not:

• Use the Site for any unlawful purpose, or in breach of the Computer Misuse and Cybercrimes Act, 2018
• Submit false, misleading, abusive or spam requests
• Attempt to gain unauthorised access to the Site, its servers or connected systems, including our HMIS
• Introduce viruses or malicious code, or disrupt the Site
• Scrape or copy content in bulk without permission

6. Intellectual property

The Site's content, including text, graphics, logos and design, belongs to Primegala or its licensors and is protected by the Copyright Act, 2001 and the Trade Marks Act. You may view and share links to our content for personal, non-commercial use. Please contact us for any other use.

7. Third-party links and services

The Site may link to or embed third-party services, such as Google Maps, WhatsApp or official SHA resources. We're not responsible for their content or practices, and their own terms apply.

8. Privacy

How we handle personal data is explained in our Privacy Policy, Cookie Policy and Communications Consent Policy.

9. Accuracy and availability

We work hard to keep the Site accurate and available, but we don't guarantee that it is error-free or uninterrupted. Services, opening hours and information may change without notice.

10. Liability

To the extent permitted by law, Primegala is not liable for any loss arising from reliance on the Site's general information or from the Site being unavailable. Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2012 or any liability that cannot lawfully be excluded, and nothing affects our professional duty of care when we provide you with treatment.

11. Advertising standards

Our communications follow the Medical Practitioners and Dentists (Practitioners and Health Facilities) (Advertising) Rules, 2016: we aim to be factual, accurate and dignified, and we don't promise particular outcomes.

12. Changes

We may update these Terms. The current version is always on this page.

13. Governing law

These Terms are governed by the laws of Kenya. Disputes will be subject to the jurisdiction of the courts of Kenya, with Nakuru as the preferred venue.
